Article 1 — Purpose and scope

These General Terms and Conditions of Sale (GTC) govern all services and product sales carried out by RideBack SRL (hereinafter "RideBack") for its customers (hereinafter "the Customer"), whether in store, by phone, by email or via the website rideback.be.

Dropping off a vehicle or placing an order implies full acceptance of these GTC. RideBack reserves the right to amend them at any time; the applicable version is the one in force on the date of the service.

Article 2 — Repair services

2.1 Vehicle drop-off
The Customer drops off their vehicle in store during opening hours. A proof of drop-off will be sent by email if the Customer completes a drop-off form. Otherwise, a message must be sent to RideBack's mobile number. By mutual agreement, a simple verbal agreement may also be sufficient.

2.2 Diagnosis and quote
A diagnosis is carried out by our technicians. A quote is sent to the Customer by email and/or SMS before any work begins when the work exceeds 60 euros. The Customer's approval is required (written or confirmed verbal reply) to authorise the work.

If no reply is received within 7 calendar days, parking fees will start to apply (see Article 4).

2.3 Performance of work
Work is carried out within the agreed time, subject to parts availability. RideBack undertakes to inform the Customer of any additional delay.

2.4 Confirmation of completion
Once the work is complete, RideBack informs the Customer by email and/or SMS that their vehicle is ready. The Customer has 7 calendar days from this notification to collect their vehicle free of charge.

Article 3 — Cleaning fee

A flat fee of €10 incl. VAT will be charged if the vehicle requires cleaning before diagnosis or repair, due to excessive dirt making the work difficult or risky for our technicians.

The Customer will be informed of this fee when the quote is drawn up.

Article 4 — Parking (storage) fees

4.1 When fees apply
Storage fees of €5 per calendar day will be charged in the following cases:

  • After 7 days from the date of notification of completion, if the Customer has not collected their vehicle;
  • After 7 days from the sending of the quote by email/SMS, without a reply from the Customer.

4.2 Cap and notification
RideBack undertakes to notify the Customer by email and/or SMS when parking fees start to apply. Parking fees accrue daily, with no contractual cap.

4.3 Payment
Storage fees are payable upon collection of the vehicle, in addition to the cost of the repair.

Article 5 — Abandoned vehicles and transfer of ownership

In accordance with Article 1 of the Belgian law on pledges and current commercial practice:

Any scooter left at RideBack's premises for a consecutive period of three (3) months, without any news from the Customer (no contact, no payment, no reply to notifications), will be considered abandoned.

In this case, the scooter will become the full property of RideBack SRL, which may freely dispose of it (resale, spare parts, destruction), with no compensation due to the Customer, after reasonable attempts at contact have been exhausted.

Before any transfer of ownership, RideBack undertakes to:

  1. Have sent at least two written notifications (email and/or messaging service);
  2. Have observed a period of 30 additional days after the last notification;
  3. Keep a documented record of all contact attempts.

Article 6 — Prices and payment

6.1 Prices
Service prices are displayed in store and available at rideback.be/pages/tarif. They are expressed in euros including VAT. RideBack reserves the right to change its prices at any time, the applicable price being the one in force when the quote is drawn up.

6.2 Payment methods
Payment is made in store by:

  • Cash
  • Bank card (Bancontact, Visa, Mastercard)
  • Bank transfer (on request)

Full payment is due before the vehicle is returned.

6.3 Deposit
For repairs estimated at more than €100, RideBack reserves the right to request a deposit of 30% to 50% before work begins.

Article 7 — Repair warranty

7.1 Duration
Repairs carried out by RideBack are guaranteed for 3 months (6 months for new parts) from the date the vehicle is returned, for the parts and labour covered by the work. Wear parts and consumables (tyres, brakes, bearings, batteries) are excluded.

Vehicle sales: used vehicles come with a 3-month RideBack commercial warranty; new vehicles come with a commercial warranty of 2 years on electrical parts and the frame, and 1 year on the battery. These commercial warranties apply without prejudice to the legal guarantee of conformity (art. 1649bis et seq. of the Belgian Civil Code), which covers defects existing at the time of delivery: 2 years for new goods and 1 year for used goods.

7.2 Exclusions
The warranty does not cover:

  • Damage resulting from misuse or a fall after repair (moisture, impact, riding with more than one person, incorrect settings, modification of the vehicle by a third party, etc.);
  • Normal wear and tear of parts;
  • Faults unrelated to the work carried out.

7.3 Claims
To claim under the warranty, the Customer must bring the vehicle back to the store with their purchase invoice if it is not in RideBack's system. RideBack will carry out a free diagnosis and perform the warranty repair at no extra cost if the cause is confirmed.

Article 8 — Liability

RideBack undertakes to take all necessary care in performing its services. However, it cannot be held liable in the event of:

  • A pre-existing fault not reported by the Customer at drop-off;
  • A hidden defect or a defect inherent to the Customer's vehicle, unrelated to RideBack's work;
  • Damage caused by a part supplied by the Customer;
  • Force majeure (supply disruption, disaster, etc.).

Except in the case of gross negligence or wilful misconduct by RideBack, and except for personal injury, RideBack's liability is limited to the amount of the service invoiced. This limitation does not affect the rights that consumer Customers have under the law, in particular the legal guarantee of conformity.

Article 9 — Product sales (webshop)

9.1 Orders
Orders placed via rideback.be are firm and final after confirmation by email. The Customer has 14 calendar days from receipt to exercise their right of withdrawal, in accordance with the Belgian Code of Economic Law (art. VI.47).

9.2 Delivery
The delivery time is stated when the order is placed. Unless otherwise agreed, delivery takes place no later than 30 days after the order. The risk of loss of or damage to the products passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of them. In the event of a delay, the Customer may grant RideBack a reasonable additional period; if the products are not delivered within that period, the Customer may cancel the order and be refunded without delay.

9.3 Returns and refunds
Returned products must be complete, in their original condition and in their original packaging. The cost of returning the product is borne by the Customer. The refund, including the standard delivery costs paid at the time of the order, is made within 14 days of notification of the withdrawal; however, RideBack may withhold it until the product has been received or until the Customer has supplied proof of having sent it back. The Customer remains liable for any loss in value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

Spare parts that have been fitted or used cannot be returned, except in the case of non-conformity.

9.4 Exercising the right of withdrawal
To exercise the right of withdrawal, the Customer must inform RideBack of their decision by an unequivocal statement, for example by email to kc@rideback.be. The Customer may use the model form below, but this is not obligatory.
